В рамках представленной публикации рассматриваются особенности договора счета эскроу: в частности, процесс учета и блокирования денежных средств. Автор отмечает, что договор счета эскроу является дополнительным по отношению к основному договору и обеспечивает гарантию оплаты бенефициару, выполненных им обязательств, которые были указаны в основном договоре. Он акцентирует внимание на том, что договор банковского счета и договор счета эскроу имеют перечень различий, которые подробно представлены в статье. Денежные средства на сам счет эскроу вносятся после регистрации договора долевого участия. При этом автор утверждает, что возможны 2 процедуры формирования эскроу-счета, которые представлены в рамках статьи. Также отмечается, что, например, термин блокирования в свете договора счета эскроу не раскрыт как таковой, поэтому в статье автор приводит пример из правоотношений. Особое внимание уделяется рассмотрению договора эскроу на примере долевого строительства, поскольку именно в ней он пользуется наибольшей популярностью. Более того, в статье схематично представлен механизм работы договоров счета эскроу в сфере строительства многоквартирных домов и иных объектов, что позволяет наглядно рассмотреть особенности взаимодействия субъектов. Одной из особенностью договора скроу является тот факт, что списание денежных средств со счета эскроу происходит без какого-либо отдельного распоряжения от застройщика или покупателя, то есть, когда застройщик сдает объект в эксплуатацию, банк единолично принимает решение о переводе средств со счета эскроу. В заключительной части статьи автор формулирует вывод относительно роли договора эскроу в системе гражданских правоотношений.
Within the framework of the presented publication, the features of the escrow account agreement are considered: in particular, the process of accounting and blocking funds. The author notes that the escrow account agreement is additional to the main agreement and provides a guarantee of payment to the beneficiary of the obligations he fulfilled, which were specified in the main agreement. He focuses on the fact that the bank account agreement and the escrow account agreement have a list of differences, which are presented in detail in the article. Funds are deposited to the escrow account itself after the registration of the equity participation agreement. At the same time, the author claims that there are 2 possible procedures for the formation of an escrow account, which are presented within the framework of the article. It is also noted that, for example, the term blocking in the light of the escrow account agreement is not disclosed as such, so the author gives an example from legal relations in the article. Particular attention is paid to the consideration of the escrow agreement on the example of shared construction, since it is in it that it is most popular. Moreover, the article schematically presents the mechanism of operation of escrow account agreements in the construction of apartment buildings and other facilities, which makes it possible to visually consider the features of the interaction of subjects. One of the features of the scrow agreement is the fact that funds are debited from the escrow account without any separate order from the developer or buyer, that is, when the developer puts the object into operation, the bank alone decides to transfer funds from the escrow account. In the final part of the article, the author formulates a conclusion regarding the role of the escrow agreement in the system of civil legal relations.
